Maternity leave question

I found out I was pregnant 2 weeks after I started my job. Since I'll be at the company less than a year when I give birth, I can only get up to 8 weeks off. I don't even know if I'll have enough vacation and sick time to get me to 8 weeks. I don't qualified for FMLA either since I haven't been there a year yet. I'm not sure what to do. I guess I can just take time off and not get paid which will stink but if that's what I have to do...

How soon after you give birth do you physically feel ready to go back to work?  I know babies have to be at least 3 months in order to go into daycare. I guess I'll have to go without pay for the last month to stay with the baby. Do father's get any paid time off for maternity leave? They just have to use their sick and vacation time too right?

How many people work at your company? Most companies don't give fathers "paternity leave", so yes, he would have to use his sick/vacation time. I was in a similar position when I was PG with DD. I got 6 weeks FMLA (because my company was large enough) and I took off the week before I had her and went back when she was 5 weeks old. I still didn't feel 100% but I was ok.

I'm assuming you live in the US?  Maternity/Paternity leaves can vary greatly.  It's important that you speak to your HR department, if your company has one.  If not, maybe there's an employee manual that has that information in it. Since you won't have been there a year, you will not qualify for FMLA (if your company is large enough for that anyway).  Even so, FMLA is not paid leave.  I'm not sure where you've gotten the 8 week figure, is that what your company provides? If you haven't been there long, I can't imagine you will have earned more than a few weeks vacation/sick leave by the time you give birth.  

Maybe you should have the baby's father look into what paternity leave policies are in place at his work as well.  GL.

nope, not true. Maybe the day care you are considering? But no, babies don't have to be 3 months to attend day care.

Babies have to be 6 weeks to enter daycare. Your SO can qualify for FMLA if he's got it at work.

TTC since May 2006. After 3 failed Clomid cycles, 2 failed Injectibles/IUIs, 2 failed IVFs and 1 failed FET, we movied on to adoption!

Have you looked into any short term disability? Getting it now is probably not helpful but if you enrolled when you started, it will most likely pay out 60 of you income for 5 weeks or my plan did. I took six weeks and was perfectly fine going back. DD was fine in DC too.

I did maternity leave and then did disability. I ended up being off about 3 months with them combined. Most likely will do the same this time around too.

Definitely look into your husbands policy for leave. Some company's allow it!

Married my BEST FRIEND on December 1, 2007. Started TTC in March 2008. Found out we were expecting our first child in October 2008 - but had a m/c in December 2008 - resulting in a d&e. I'm wondering where you got that 8 week figure.  Because if your company has told you that they will give you this time off and your job will not be at risk, you need to get that in writing because they are not legally required to do that and without something in writing, they'd be (shittily) within their rights to up and change their minds.

If the 8 weeks is something you believe you qualify for via short term disability, please know that even if you qualify for disability, if you don't ALSO qualify for the job protection of FMLA, your company doesn't have to let you take the time, which is why I asked if they've actually stated your job is secure.  

As for paternity leave, that just varies company to company so your husband would have to ask.  But he would likely qualify for FMLA (assuming he and his company meet the guidelines) which means he could take 12 weeks by maxing out his sick/vacation time and taking the rest unpaid.

I went back to work at 6 weeks. My husband has never gotten time off other than while I was in the hospital.

I went back to work when DD was 6 weeks.  I felt like it was early but I didn't really have a choice at the time.  There are lots of daycares that will take infants as young as 6 weeks.

I went back with DD2 at 8 weeks and I could have gone sooner (I had a c-section). Also, many daycares take babies earlier...what else would people without long leaves do? ours starts at 6 weeks.

My husband got two weeks of paid paternity off with our first aside from his PTO. That was really awesome for us but unfortunately isn't common here in the US. It's still worth checking though. 

I second the 6 week daycare rule. Look around at different daycare options.

I went out on maternity leave 3 weeks after I started a new job. I didn't qualify for FMLA obviously but I spoke to my manager and HR ahead of time and they agreed to give me the full 12 weeks anyway. It doesn't hurt to ask.  And Paternity Leave varies by job.  My DH got two weeks paid.  Then he took a few weeks of vacation time.

But like PP said, if your husband is at a large enough company and has been there more than a year, he can take the FMLA instead of you if you need someone home with the baby longer than you can be there.  

I personally was not ready to go back before 12 weeks.  But I had a rough delivery and tore really badly and was still crying when I sat down at 6 weeks.  Many people go back at 6 weeks with no issues.

i had a c-section and wouldnt have been cleared to work for 8 weeks. you need to take at least the recommended healing time. honestly, i wouldnt have been ready at 8 weeks, i was so sleep deprived. i took 14 weeks with DD. I'm taking longer this time. probably about 5-6 months.

Unfortunately for me im a full time freelancer. If im not there i dont get paid. I believe hubby gets 3 days paid "paternity." But he can use his sick time or vacation time if he wants some more paid time off.
His company should meet the FMLA requirements but i dont think hes going to take unpaid weeks off.
Im just going to stay home unpaid. Maybe do some at home freelance work if i find some.

I'm also wondering where you got the 8 week thing, or if your employer has told you that. A lot of places don't have a  "maternity" leave, but rather you take short-term disability. I just switched jobs, but my previous employer automatically paid into your STD, but at my current job you have to choose to sign up for STD when you're enrolling for benefits and then pay into it yourself, and then the payout is 60% of your wages for 6 weeks for a vaginal birth or 8 weeks for a c-section, and if you want to take more or less you have to take PTO or cover the difference in wages with PTO.

I would check into your husband's company just to see what they offer.

Everywhere I've looked into takes babies at 6 weeks....

i second asking about FMLA despite not being there for a year. i will be around 36 weeks when i hit my one year mark at work and they said they would still give me FMLA if for some reason i went early

my manager said they are more strict on the on the one year rule when people apply for FMLA for other reasons but, when it comes to maternity leave they work with people.

Paternity leave falls under FMLA if the company qualifies. FMLA allows for 12 weeks leave.
