Maternity leave in CA... advice??

Anyone in CA worked out the maternity leave for CFRA or FMLA? I am a smart cookie but struggling with it and not sure if it is 12 weeks or 16 and when that starts. If I went off work 2 weeks prior to delivering assuming no complications or health issues what would I get and when would it start? TIA!

Multiple ectopics, 2 failed IVF's
IVF #1: Did not get to ET, embies all failed PGD (major chromosomal defects)
IVF #2: We have 2 chromosomally perfect embies as a result of PGD (Boy/Girl)1 failed the thaw - transferred 1, ended as c/p
Thought it was the end of our TTC Journey 6/20/2012
SHOCK BFP 9/28/2012 ~ IT'S A BOY! and everything is normal!!!!!!

I'm a FTM and overwhelmed also, but this is what I understand from my HR office -

 

CFRA is good for up to 12 weeks. I can take up to 4 weeks off before birth (as reccomended by doctor), and have 6 weeks after vaginal birth or 8 weeks after c-section.

FMLA can kick in after that. It's another 12 weeks that can be taken any time up to baby's 1st birthday.

Thanks! So then from the delivery date it "could" be 18 weeks after? Sounds a lot but if it is right I will take it!

I don't remember 100 sure but I know I had 2 weeks before I delivered on disability. 6 week post partum for vaginal or 8 weeks for csection. Then paid family leave is either 6 or 12 weeks... I forget. My DH got 6 weeks off too for paid family leave. Of course this is only a percentage of your usual income, but it's nice. I don't get any of that stuff this time around... I'm self employed.

FMLA is just job protection for 12 weeks. 

In CA you get 6 weeks for a vaginal delivery and 8 weeks for cesarean and it is paid at a portion of your salary (I didn't collect this so I don't know the %). You can download the paperwork online for your dr. to fill out. This is pretty routine for them, though some offices do charge a fee (mine charges $30 per form). This is paid through short term disability and has nothing to do with paid family leave or FMLA.

Just a reminder that if you work for some government agencies, you may not be eligible for state disability, but you will be covered by FMLA.

I think it's something around 55% of your pay.

You'll need to check with your HR, CFRA and FMLA can run concurrently. It really depends on your companys stance on this. I work in HR and maternity leave is way confusing to me since I don't deal with it too often. I do know that between all the available leaves you can essentially take up to 7 months off, however FMLA only provides job protection for up to 12wks. Check your handbook, there should be leave info there.

To answer one of your questions FMLA starts the first day you are on leave.

This but of the 12 weeks FMLA only 6 are paid. All 12 your job is protected.
